These Terms and Conditions constitute a legally binding agreement between you, as a user (hereinafter referred to as the “User”) and Rooney Georgia LLC (Business ID: 405761153) (hereinafter referred to as the Company), and govern the terms and conditions of use of the Company’s website/platform.
For the purposes of this document, the User and the Company are hereinafter collectively referred to as the Parties and individually as a Party
Any user who plans to use the Company's platform is obliged to agree to these terms and conditions. The user's agreement to these terms constitutes confirmation that he agrees to receive the services provided by the Company on this platform in accordance with the established terms and conditions, and in case of purchasing tickets and registering on the platform, the user automatically confirms his agreement to these terms.
You are hereby informed that by registering on this Platform and/or purchasing a ticket(s) without registration, you agree to the processing of your personal data as a user and to the Company sharing it with third parties in contractual relations with the Organizer and/or the Company, if sharing this information is necessary to receive the services provided by the Platform. The Company's processing of personal data is regulated in accordance with the legislation of Georgia and the Company's Privacy Policy.
The Company has the right to update or change the Terms of Service at any time and such changes will be automatically published on the Website. Changes may be made due to changes in legal conditions. The Company's Website is constantly undergoing technical improvements and changes, to which the User agrees by registering on this Platform and the Company may unilaterally implement any such technical improvements.
The terms used in this document have the following meanings, unless the context otherwise requires:
Company - Runi Georgia LLC, identification code: 405761153, address: 18a Parnavaz Mepe Avenue, apartment N59, Saburtalo district, Tbilisi, Georgia, which provides users with 24/7 access to the Platform and offers the purchase of various categories of tickets.
User - an individual who uses the Platform to purchase tickets for an event planned by the Organizer.
Organizer/Customer - an individual or legal entity who sells tickets for an event planned by the Company through the Platform.
Platform/Website - the official Internet resource owned by the Company - www.rune.ge, to which the User has 24/7 access to purchase tickets of various categories, as well as any other communication channel used to provide the User with services provided for in these Terms and Conditions.
Event - any type of event published on the Company's Platform..
Ticket - a document confirming the right to enter the Organizer's event, which the Company issues in electronic form in the event of purchase by the User.
Platform Fee - the fee for services provided by the Company to the User.
Transaction Fee - a fee charged by a bank or any other payment company when performing any financial transaction.
The Company declares and guarantees:
The Company acts as an intermediary between the Organizer and the User, helping the Organizer to sell tickets for the event it organizes by posting them on the Platform, and allowing the User to purchase a ticket to attend the desired event. Given all of the above, the Company cannot be held responsible for the consequences arising from the relationship between the User and the Organizer, including:
In addition, all other issues (both substantive and technical) that are directly related to and arise from the Organizer.
The Company guarantees that the details of the event provided by the Organizer will be fully reflected both on the ticket and on the platform. However, it also states that the Company is not responsible for the accuracy and content of the information provided by the Organizer. The Company does not verify the information provided.
The Company is not responsible in cases where the platform or any of its services becomes fully or partially unavailable for a certain period of time, a technical fault or other disruption occurs. Accordingly, the Company does not guarantee that the platform will operate continuously and without faults. Technical disruptions can also be caused by high user activity, a large number of people wishing to purchase tickets to attend the same event at the same time.
The Company declares and guarantees that it makes every effort to protect the Platform from various types of malicious attacks, however, the Company is not responsible for any damage caused to the User through a cyber-attack or other fraudulent means.
The Company is not responsible for unauthorized access to or theft of User materials, nor is the Company responsible for damage to the User's or any third party's personal technical device as a result of any program downloaded from the Platform or shared information.
The Company has the right to refuse to carry out a specific transaction by the User as a result of processing the User's personal data, if the Company has reasonable doubt as a result of the processing of the information and/or if the User is suspected of various fraudulent actions, whether related to payments with plastic cards or any other type of action, as well as in the event that the User violates these Terms and Conditions posted on the Platform, the Privacy Policy or otherwise.
The User confirms that he/she is an adult (18 years of age or older) and is not under any kind of physical or psychological pressure, or under the influence of alcohol, drugs, or other toxic substances at the time of registration on the platform.
Accurately and thoroughly understands the content of these Terms and Conditions on the Platform and understands the legal liability arising in the event of its violation.
By registering on this platform, the User confirms that he/she has thoroughly read these terms and conditions and also confirms that the information provided by him/her during the registration stage on the platform is accurate and truthful. Accordingly, the Company is not responsible for the accuracy of the User's data and for any damage arising from the provision of incorrect information.
The User confirms the Company's authority to verify and process any information provided by the User, including personal data of the person, after registration on the Platform (until the cancellation of the registration in accordance with the account closure rules provided for in these Terms and Conditions).
The User undertakes to immediately notify the Company of any changes to the information provided at the time of registration, as well as of any circumstances that may conflict with these Terms and Conditions, as well as the User's representations and warranties.
The User is obliged to protect the confidentiality of his/her personal data registered on the Platform, and therefore not to share his/her personal data, registered name and password with third parties. The Company is not liable for any damage arising from unauthorized access by third parties in such a case.
By registering on this platform and agreeing to these terms and conditions, the user guarantees that he will use the platform only for the purposes of the platform, in accordance with applicable law.
General conditions for purchasing tickets
To purchase a ticket to an event, the user must register on the platform using the appropriate instructions. Registration is also possible using Facebook and Google.
Payment on the platform is made by transfer
The purchased electronic ticket will be sent to the email address provided by the user during registration and/or purchase on the platform. For registered users, the purchased ticket will also be reflected on the platform.
After completing the transaction, the user is obliged to check whether the ticket has been reflected on the platform and/or by e-mail. A ticket purchased by e-mail is sent immediately after purchase. Accordingly, the user is obliged to immediately contact the platform's customer support team in case the ticket is not reflected/sent on time. In case the user makes a request, the customer support team will try to eliminate the problem as soon as possible. In the event that the number of tickets for sale is exhausted, the Company will immediately return the amount paid for the ticket to the same account from which the payment was made, including all other paid commissions.
It is possible that the ticket for attending the event is personal, which means that the user's name and surname and/or other additional information are printed on the ticket. In such a case, the user is obliged to verify the accuracy of the information entered and, if an error is found, immediately notify the customer support team. Otherwise, if your admission to the event is not granted, the Company will not be responsible and, accordingly, the ticket price will not be reimbursed.
It is possible that the number of tickets may be limited due to the specifics of the event. The organizer provides information to the Company on the number of tickets for sale.
The Company reserves the right to set a maximum limit for the purchase of tickets by one user for one event.
Some event organizers may require additional verification for users, in which case the user will be allowed to purchase a ticket only if they have passed the pre-verification and been confirmed by the organizer. It is also possible that the event organizer will not allow a person to enter the event who fails the on-site further verification, which is established by the organizer in accordance with its terms and conditions. The user will be warned about the pre- and post-verification by the event organizer, therefore, the user has no right to request a refund of the ticket in case of failure to pass the verification.
In case of high demand, some events may have a queue, so if tickets are completely sold out before a specific queue number becomes available, the user with that queue number will not be able to purchase a ticket. If the user successfully purchases a ticket, the platform will automatically return to the home page after the purchase and their queue number will be cancelled.
Some purchased tickets may have a QR code on them, which is unique. Therefore, do not share the QR code with third parties, do not take a photo of it and upload it to a social network or other platform, since in case of such a ticket, attendance at the event can be achieved by scanning the QR code using a special device, once. Otherwise, the Company disclaims responsibility for the consequences caused by sharing the QR code.
The platform may contain various promotions and/or discounts offered by the Company or the organizer. In such a case, please read the information provided in detail and follow the instructions provided in it when using it. The promotions offered are individual. It is also possible that the Company and/or the organizer may offer you a promo code that is for one-time use, the validity of which is determined solely by the Company/organizer.
Ticket refund terms and conditions
The Company acts as an intermediary between the organizer and the customer, therefore, in the event of cancellation/postponement/failure to pass pre-verification or failure to pass verification at the event site, responsibility rests with the organizer, therefore the organizer is the responsible party.
The Company is not obligated to notify the User of the postponement/cancellation of any event through the Platform. The event organizer will publish the above information on the relevant websites. Accordingly, the Company is not responsible for the late notification of information about the postponed/cancelled event and the consequences thereof.
The organizer makes the decision on the refund of purchased tickets. Tickets can be refunded in the event of cancellation/postponement of the planned event.
When an event is postponed, the organizer may offer the user the opportunity to use the purchased ticket on the changed date and/or the user may return the ticket and be reimbursed for the ticket price, excluding platform service and transaction fees.
Please be informed that the ticket refund is made at the discretion of the organizer, taking into account the relevant rules and conditions. Accordingly, the organizer may establish different rules and terms for the ticket refund, which will be indicated on the organizer's and/or the relevant event's websites. In such case, the ticket refund will be made in accordance with the terms and conditions established by the organizer.
In case if the event organizer has not determined the rules and conditions for returning tickets and there is no other basis for returning tickets that is provided for in these terms and conditions, the Company is not obligated and is not responsible for returning tickets only at the request of the user.
To request a refund, a customer must contact the customer support team and/or use the ticket refund functionality available on the platform. The availability of a ticket refund functionality is determined by the organizer, in accordance with the terms and conditions established by it. In case of violation of the aforementioned terms and conditions, the ticket refund functionality will no longer be available to customers.
Ticket refunds will be made to the same bank account from which the tickets were purchased.
Please note that incorrectly purchased tickets cannot be returned or exchanged. Therefore, please read the event details carefully before purchasing a ticket. Otherwise, the Company is not responsible for the consequences of an incorrectly purchased ticket.
Ticket refunds will be made within a reasonable timeframe, taking into account the high demand.
Please note that if the organizer refunds the ticket price for a cancelled or postponed event through the Company, the customer will only be refunded the ticket price, excluding platform service and transaction fees.
The Platform (including any changes and improvements made during the term of the Agreement) is the exclusive intellectual property of the Company and is fully subject to all proprietary and non-proprietary rights provided for by the Georgian legislation on the Company's ownership, copyright and related rights. It is prohibited to modify, adapt and/or perform any other actions that are exclusive to the Company without the prior written consent of the Company.
The parties declare and confirm that the terms of this Agreement do not constitute a transfer of trade, commodity, copyright and/or any other intellectual property, and all rights not expressly granted in these Terms and Conditions are retained by the Company.
Failure to comply with the terms and conditions set forth in this Article constitutes a violation of the Company's intellectual property rights and entitles the Company to seek legal remedies provided for by Georgian law.
The User is authorized to use the Platform and its software only in accordance with these Terms and Conditions and does not have any intellectual property rights related in any way to the Platform.
Any information, text, photos and graphics posted on the Platform are the property of the Company and its use in any form is prohibited. This action will result in liability in accordance with the current legislation of Georgia.
The terms of intellectual property protection provided for in this article shall apply without limitation and for life.
The company's material liability is limited to the amount of the ticket price to attend an event, excluding all other additional fees.
The user has the right to contact the customer support team at any time, without any justification, and request the closure of her/his account on the platform and the deletion of data. After receiving this request, the Company will close the account and delete the data within a reasonable time, unless the Company is not authorized to close the account and delete the data for legitimate and/or legal purposes. A legitimate purpose may be a user's various financial or other obligations to the company. A legal purpose may be to appeal to an official authority, which prohibits the deletion of a specific user's data and the closure of an account for a certain period of time. The prohibition may arise in cases where account-related data is required for the purpose of detecting/preventing/mitigating or investigating fraudulent or illegal activities, for compliance with regulations or for other legitimate purposes. In such cases, all data processed and stored by the Company is protected in accordance with the Law on Personal Data Protection of Georgia and the Company's internal policies.
These Terms and Conditions (Agreement) come into force from the moment the User registers on the Platform, as well as from the moment of financial transactions carried out without registration, and are valid until the User's account is closed.
The Company reserves the right to unilaterally amend these Terms and Conditions at any time. The relevant amendments will be reflected on the Platform. The amended Terms and Conditions will enter into force upon their posting on the Platform.
If the user does not close their account in the event of changes to the terms and conditions, it is considered that she/he accepts the changes.
The Company has the right to close the User's personal account on the Platform unilaterally, without further consent of the User, if the User violates these Terms and Conditions, does not use the Platform in accordance with the established rules and/or is noticed in suspicious transactions. Also in the event of any reasonable suspicion or legitimate grounds.
The relations between the parties shall be governed by the legislation of Georgia. Either party may apply to the courts of Georgia for resolution of any dispute.
These Terms and Conditions and any other agreement between the parties relating to the use of the Platform constitute the entire agreement and supersede all other verbal or written communications between the parties.
The user has the right to contact the customer support team in case of any complaint.
Cases not directly regulated by these Terms and Conditions shall be regulated in accordance with the laws of Georgia.
